Policy Achievements

LOCAL

★ Defeated a Metro Nashville tree preservation ordinance

★ Negotiated with the City of Franklin to reduce municipal water and sewer fee increases (achieved a $900/sq foot reduction, defeated proposal to raise fees exponentially over four years)

★ Amended Metro Nashville legislation to implement new construction & demolition recycling
requirements, ensuring the industry was not burdened by new requirements

★ Worked with Metro Council to draft a construction noise amendment

★ Defeated a proposal to raise road impact fees by 300% in the City of Franklin

STATE

★ Passed legislation allowing 3rd party electrical inspections

★ Passed legislation allowing 3rd party plan review and inspections

★ Supported legislation requiring cost-sharing agreements for offsite utility improvements

★ Passed legislation allowing the use of “real estate infrastructure districts” which provides for cost sharing for infrastructure requirements

2025 RECAP

NAIOP kicked off 2025 with the introduction of the Real Estate Infrastructure Development District Act at the state legislature. This act was signed into law in May of this year, making a new tool for public/private partnership building of infrastructure available to development and local governments.
NAIOP also supported legislation at the state legislature to require local government accounting disclosure for any local development fee over $250.
At the local level, we pushed for required accountability around service improvements as Nashville's Department of Transportation sought to drastically increase its fees. Additionally, NAIOP successfully blocked an effort by the City of Lebanon to prohibit all new development of warehouses.

2026 PRIORITIES

LOCAL: 

★ Push for service accountability amendment as NDOT seeks to revise its effort to increase fees in 2026

★ Engage in active advocacy to support industrial development in Middle TN

★ Ensure local governments accept proposals for Infrastructure Development Districts

STATE:

★ Pass legislation with revisions to 2025's Real Estate Infrastructure Development Districts

★ Support legislation to amend bill enabling third party plan review and inspections

★ Support legislation setting limits and a shot clock for local plan review

★ Support legislation allowing for the monetization of TIF districts
